Silver King Fire Area, Road, and Trail Closure

 

PROHIBITIONS 

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a) and (b), the following are prohibited in the National Forest System (NFS) lands, roads, and trails in the Beaver Ranger District of the Fishlake National Forest described in this Order and shown on the attached map incorporated into this Order as Exhibit A (“Described Area, Roads, and Trails”):

1. Going into or being in the Described Area. 36 C.F.R. § 261.52(e). 

2. Being on the Described Roads. 36 C.F.R. § 261.54(e). 

3. Being on the Described Trails. 36 C.F.R. § 261.55(a).

 

EXEMPTIONS

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order.

  1. Persons with Forest Service Permit No. FS-7700-48 (Permit for Use of Roads, Trails, or Areas Restricted by Regulation or Order), specifically exempting them from this Order or a written determination by a Forest Service authorized officer that a permit is not required under 36 C.F.R. § 251.50(e)(1) or (2).
  2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.
  3. Livestock Permittees and Deer Trail Mine personnel with a permit from the US Forest Service for permitted activities located within the Described Area.

DESCRIBED AREA, ROADS, AND TRAILS

The Described Area is all NFS lands within the following boundaries: Starting at the junction of Interstate 70 (I-70) and Fish Creek, proceeding East along south side of I-70 to south side of Castle Rock Campground, from there Northeast to NFS Road 475, following NFS Road 475 to junction with I 70, then East to the Forest Boundary, from there South along Forest Boundary to Tenmile Creek, then West along Tenmile Creek up to City Creek Peak, following the Beaver/Piute County Boundary North to Poison Creek, then down the drainage of Poison Creek to Poison Creek Gate on NFS Road 123,

following NFS Road123 to Beaver/Piute County Boundary, then following county boundaries North to Mount Baldy, from there North along the Fish Creek drainage back to junction with I-70.

Castle Rock campground is outside of the Described Area and remains open to the public.

The Described Roads and Trails include all, or portions of, the following NFS roads and trails that are located within and bordering the Described Area:

1. NFS Roads 113, 115, 116, 120, 123, 125, 126, 128, 136, 473, 474, 475, 476, 480, 577, 578, 585, 608, 609, 756, 1000, 1019, 1020, 1030, 1034, 1037, 1039, 1040, 1041, 1042, 1044, 1045, 1047, 1048, 1051, 1077, 1078, 1079, 1080, 1081, 1082, 1085, 1094, 1095, 1100, 1105, 1106, 1108, 1110, 1111, 1112, 1113, 1114, 1115, 1118, 1121, 1122, 1123, 1124, 1125, 1738, 2051, 2056, 2058, 2327, 2346, 2347, 2348, 2349, 2352, 2353, 2361, 2362, 2363.

2. NFS Trails 43, 48, 048A, 50, 51, 53, 72, 73, 74, 83, 207, 208, 209, 213, 214, 215, 216, 219, 224.

 

PURPOSE

The purpose of this Order is to protect public safety during the Silver King Fire.

 

IMPLEMENTATION

1. This Order shall be in effect from July 9, 2024, at 6:00 A.M. through August 30, 2024 unless rescinded.

2. A map identifying the Described Area, Roads, and Trails is attached and made part of this Order as Exhibit A.

3. Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter II, Parts 200-299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter II, Parts 200 299, their meaning shall be determined by their plain language definitions.

4. A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C. §§ 3559, 3571, and 3581.
