PROHIBITIONS
Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a), the following acts are prohibited on all National Forest System lands as described in this Order (the “Restricted Area”) and as depicted on the attached map, hereby incorporated into this Order as Exhibit A, within the Carson National Forest, Taos, Rio Arriba, Mora, Colfax Counties, State of New Mexico.
1. Going into or being upon the Restricted Area. 36 C.F.R. §§ 261.52(e), 261.53(e).
EXEMPTIONS
Pursuant to 36 C.F.R. §261.50(e), the following persons are exempt from the provisions in this Order:
1. Persons with a written Forest Service authorization specifically exempting them from the effect of this Order.
2. Any Federal, State or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty as approved by the District Ranger.
3. Residents using roads in the Restricted Area to the extent necessary to access their private property.
RESTRICTED AREA
All National Forest System lands, roads and trails within the boundary of the Carson National Forest within the following counties: Taos, Rio Arriba, Mora, Colfax counties within the State of New Mexico.
PURPOSE
This Order is necessary to protect public health and safety due to extreme fire danger.
IMPLEMENTATION
1.This Order will be in effect at 8:00 AM on May 19th, 2022, and shall remain in effect until July 18, 2022 or until rescinded, whichever occurs first.2.A map identifying the Restricted Area is attached and made part of this Order as Exhibit A.3.Any violation of the prohibition in this Order is punishable as a Class B misdemeanor by a fine of not more than $5000 for an individual or $10,000 for an organization, or by imprisonment for not more than six (6) months, or both (see 16 U.S.C. § 551, 18 U.S.C. § 3571(b)(6), 18 U.S.C. § 3581(b)(7)).4.Further information regarding this Order may be obtained at the Camino Real, Canjilon, El Rito, Jicarilla, Questa, and Tres Piedras Ranger Districts located in Penasco, NM, Canjilon, NM, El Rito, NM, Bloomfield, NM, Questa, NM and Tres Piedras, NM, telephone numbers Camino Real (575) 587-2255, Canjilon (575) 684-2489, El Rito (575)581-4554, Jicarilla (505) 632-2956, Questa (575) 586-0520 and Tres Piedras (575) 758-8678, and at the Carson National Forest Supervisor’s Office in Taos, NM, telephone number (575) 758-6200.5.All existing Stage II Restrictions under Order No. 02-507 , remain in effect.6.This order rescinds order number 02-508.
