FOREST ORDER
National Forest System Area Closure - Haystack Fire
Pursuant to 16 U.S.C. § 551, 36 C.F.R. § 261.50 (a) and 36 C.F.R. § 261.52 (e) the following acts are prohibited on the Butte Ranger District, Beaverhead-Deerlodge National Forest.
PROHIBITION: 1. To go into or be upon the area described below [36 C.F.R. § 261.52(e)].
AREA CLOSURE DESCRIPTION: As depicted on Attachment A, the area closed by this Order is as follows: Starting in the southeast corner of Section 16 (T4N R6W) just south of the Nez Perce Creek Forest Road No. 78154; then due north to the northwest corner of Section 4 (T4N R6W); then due west to the forest boundary in the southwest corner of section 33 (T4N R6W); then north following the boundary of forest and private property to the southwest corner of Section 21 (T5N R6W) where it intersects with Interstate 15; then northeast following Interstate 15 to the north central portion of Section 10 (T5N R6W) where the Interstate intersects with a Northwestern Energy powerline; then northeast following the powerline to the intersection with FS Road 5129 in section 2 (T5N R6W) ; then east along FS Road 5129 to the junction of FS Trail 7079 in the southeast corner of Section 1 (T5N R6W); then north following FS Trail 7079 to the junction of FS Road 1566 in the center of section 31 (T6N R5W); then southeast following FS Road 1566 to the junction of FS Road 638 in the south central portion of section 33 (T6N R5W); then northeast following FS Road 638 to the forest boundary in the southwest corner of section 23 (T6N R5W);then east following the forest boundary to the southeast corner of section 23 (T6N R5W); then due south following the forest boundary to the southeast corner of section 26 (T6N R5W); then east following the forest boundary to the northeast corner of section 36 (T6N R5W); then south following the forest boundary to the southeast corner of section 1 (T5N R5W); then east following the forest boundary to the northeast corner of section 7 (T5N R4W); then south following the forest boundary to FS Road 638 in the southeast corner of section 7 (T5N R4W); then southeast following FS Road 638 to the junction of FS Road 86 in the southeast corner of section 7 (T5N R4W); then east following the forest boundary to the intersection of the Whitetail road in the north central portion of section 16 (T5N R4W); then south following the Whitetail road Order Number 2021-D4-037 to the south central portion of section 33 (T5N R4W); then west following the forest boundary to the northeast corner of section 6 (T4N R4W); then due south following the forest boundary to the southeast corner of section 7 (T4N R4W); then west following the State Creek road 8592 to the terminus of road 8592 in the northwest corner of section 15 (T4N R5W) near the State Creek mine; then west to the northwest corner of section 16 (T4N R5W); then due south following the section line to the southwest corner of section 16 (T4N R5W); then due west following the section line to the southwest corner of section 18 (T4N R5W); then due south to the southeast corner section 13 (T4N R6W); then due west following section lines to the starting point in the southwest corner of section 16 (T4N R6W).
PURPOSE: This closure is for public health and safety due to the Haystack Fire.
IMPLEMENTATION: This order will be in effect from September 26, 2021, and shall remain in effect until October 31, 2021, or until the order is rescinded, whichever occurs first. These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A.
EXEMPTIONS: Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order: (1) Persons with a Forest Service special use authorization or other authorization specifically exempting them from the effect of this Order; 36 CFR § 261.50(e)(1). (2) Owners or lessees of land in the area; 36 CFR § 261.50(e)(2). (3) Residents in the area; 36 CFR § 261.50(e)(3). (4) Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty. 36 CFR § 261.50(e)(4).
VIOLATION: Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, imprisonment for not more than 6 months, or both. (16 U.S.C. §551 and 18 U.S.C. §§ 3559, 3571(b)(6) and 3581(b)(7). Order Number 2021-D4-037
